row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221;][vc_column][vc_column_text]Italian law number 122\/ 2005 (protection for buyers of on-plan buildings) disposes warranties for consumers purchasing off-plan buildings by professional construction companies.<\/p>\n<p>&nbsp;<\/p>\n<p>Due to law 122\/2005, the constructor is obliged to :<\/p>\n<ul>\n<li>At the subscription of the selling preliminary contract the seller has to provide a surety bond emitted by a Bank or an Insurance Company, equal to the sum the buyer is giving before final contract, otherwise the preliminary contract is unlawful and void.<\/li>\n<li>In practice the surety bond guarantees the money paid by the buyer as a deposit, in fact the surety bond could be called-in in case the constructor falls in an economic crisis.<\/li>\n<\/ul>\n<p>At the final deed the constructor has to give to the customer a 10 years insurance policy that covers the eventual damages caused by buildings defects, otherwise the buyer could raise a claim in a court and the contract will be invalidated.<br \/>\nThe predicted surety bond could be enforce as well in case the constructor doesn\u2019t provide the insurance policy to the Notary for the deed.<\/p>\n<p>&nbsp;<\/p>\n<p>In practice the surety bond guarantees the money paid by the buyer \u00a0as a deposit, in fact the surety bond could be called-in in case the constructor falls in an economic crisis.<\/p>\n<p>At the final deed the constructor has to give to the customer a 10 years\u00a0 insurance policy that covers the eventual damages caused by buildings defects, otherwise the buyer could raise a claim in a court and the contract will\u00a0 be invalidated.<\/p>\n<p>The predicted surety bond could be enforce as well in case the constructor doesn\u2019t\u00a0 provide the insurance policy to the Notary for the deed.<\/p>\n<p>Both the surety bond and the insurance policy must be compliant with the standard fixed by the Decree \u00a0to be emitted\u00a0 by Justice and Development Italian Ministries within 16<sup>th<\/sup> of\u00a0 March 2019 (as per Law 122\/2005 article 3 and 4).<\/p>\n<p>In the end the pillars of\u00a0 Italian\u00a0 law \u00a0about \u00a0\u00a0on-plan building purchasing are two:<\/p>\n<p>Protection of the customer from losing the payments done during building construction.<\/p>\n<p>Protection of the customer against the damages and subsequent expenses connected to defects of the building.[\/vc_column_text][\/vc_column][\/vc_row][vc_row css_animation=&#8221;&#8221;
